These Terms of Use (“Terms”) govern your use of Moca’s applications and services (“the Services”), which include:
- Moca Wallet – a non-custodial wallet for sending, receiving, swapping, and paying with crypto across multiple blockchains.
- Moca POS – a point-of-sale interface for merchants to accept crypto payments in everyday transactions.
- Moca Messenger – a decentralized, end-to-end encrypted chat built on the Matrix protocol.
By accessing or using any Moca product, you acknowledge and agree to these Terms. If you do not agree, you should discontinue use of the Services.
1. Nature of the Services
- Moca applications are non-custodial, permissionless interfaces.
- We do not process, custody, or control funds.
- Transactions and communications occur directly on public blockchains or decentralized protocols (e.g., Maya, ThorChain, Matrix).
- We do not support payments in fiat currencies, fiat conversions, or fiat off-ramps.
- Moca provides the interface; you remain in control of your assets, messages, and keys at all times.
2. User Responsibilities
As a user of Moca products, you are solely responsible for:
- Creating, securing, and backing up your wallets, private keys, recovery phrases, and authentication methods.
- Safeguarding your device and ensuring the confidentiality of your credentials.
- Verifying all transaction details before confirming. Blockchain transactions cannot be reversed.
- Backing up your encryption keys for Messenger. Moca cannot restore lost conversations or access.
- Complying with all applicable local laws, regulations, and tax obligations.
- Conducting your own due diligence when interacting with third-party protocols, servers, or services.
3. Product-Specific Provisions
Moca Wallet
- Transactions occur directly on supported blockchains.
- Swaps and cross-chain transfers may use third-party protocols such as Maya or ThorChain.
- We cannot access or recover lost wallets, passwords, or funds.
Moca POS
- Merchants are responsible for entering accurate payment information.
- Transaction data is public on blockchains and cannot be reversed.
- Moca POS provides reporting dashboards, but compliance with local laws and regulations remains the merchant’s responsibility.
Moca Messenger
- All messages are encrypted end-to-end using the Matrix protocol.
- We do not monitor, store, or process your conversations.
- If you connect to third-party Matrix servers, their policies apply.
4. No Custody, No Recovery
- We do not custody private keys, recovery phrases, or message content.
- We cannot restore lost wallets, reset passwords, or recover encrypted conversations.
- All transactions and communications are final once processed by the relevant blockchain or protocol.
5. Disclaimers and Limitation of Liability
- Moca Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied.
- We make no guarantees regarding:
- Blockchain or protocol uptime, performance, or security.
- Delivery, success, or completion of any given transaction or message.
- Accuracy or reliability of third-party protocols or servers.
- Token prices, market volatility, or liquidity.
To the maximum extent permitted by law, Moca and its contributors are not liable for any direct, indirect, incidental, consequential, or special damages, including but not limited to lost assets, lost messages, lost profits, or loss of data, arising from use of the Services.
6. Third-Party Services
Moca products may integrate with decentralized protocols or federated servers (e.g., Maya, ThorChain, Matrix). We do not control these services and are not responsible for their availability, reliability, or privacy practices. You are solely responsible for reviewing and understanding the terms of any third-party services you choose to use.
7. Updates to the Services
We may update or modify Moca products at any time without prior notice, including for security, performance, or functionality improvements. Continued use of the Services after updates constitutes acceptance of the changes.
8. Termination
We reserve the right to suspend or terminate usage of Moca products in cases of misuse, abuse, or attempts to compromise the security or integrity of the Services.
9. Governing Principles
These Terms are governed by the general principles of decentralized software use. Moca products are non-custodial, permissionless interfaces operating on public blockchains and protocols. By using the Services, you acknowledge that they are not subject to the laws of a single jurisdiction. Any disputes arising under these Terms shall, where legally required, be resolved under neutral international principles of law, rather than the exclusive laws of any one country.
